FinSA regulates the provision of financial services and offering of financial instruments, while the FinIA sets out the licensing requirements for regulated financial institutions, with the exception of banks, which continue to be regulated by the Banking Act. Both laws will have significant implications for the Swiss fund and asset management industry. Notably, the previously unregulated independent asset managers, will newly be subject to FINMA authorisation and regulation.
